Claims conditions

  1. This Complaints Procedure has been prepared in accordance with the provisions of Act No. 40/1964 Coll., Civil Code, No. 513/1991 634/1992 Coll., Consumer Protection Act, as amended and applies to consumer goods for which the buyer's liability rights are exercised during the warranty period for defects.
  2. The warranty period for consumer goods is 24 months and is extended by the period during which the goods have been under warranty repair.
  3. The consumer may make a legitimate complaint in one of the following ways:

    - by e-mail: lusti@lusti.cz
  4. When submitting a complaint, the consumer is obliged to provide evidence of:
    - proof of sale of goods (tax document, invoice, warranty card),
    - claimed goods with all accessories
    - a detailed description of the defect.
  5. At the company's premises, the consumer is provided with a receipt for the claim.
  6. The right to invoke the guarantee is extinguished if:
    - wear and tear caused by normal use,
    - improper handling and use contrary to the instructions or user manual,
    - damage from the elements (e.g. water, fire or lightning, etc.),
    - damage caused by excessive loading,
    - damage to the goods in transit (this claim is to be settled directly with the carrier).
  7. In the event of a legitimate complaint, the goods are repaired free of charge to the consumer. If it is an irreparable defect, the goods are replaced with new ones. In the case of replacement, a new warranty period starts.
  8. The time limit for the settlement of the complaint including the removal of the defect without undue delay is 30 calendar days, if the parties agree otherwise. This period shall begin on the date of receipt of the complaint. If the deadline is not met, the consumer has the right to have the defective goods replaced or to withdraw from the contract.

This Complaints Procedure shall come into force on 1 January 2011. Subject to change.
